Frequently asked questions
What is a patent?
A patent is an exclusive set of rights granted by the government to an inventor for a period of 20 years under the Indian Patent Act. It gives the inventor the exclusive right to make, use, and sell the invention, preventing others from commercially exploiting it without permission.
What are the types of patent applications?
There are two main types: Provisional Patent Application — ideal for early-stage R&D, ideas, and concepts. It secures your filing date for 12 months while you complete the invention. Complete Patent Application — for finished inventions with full claims, description, and drawings. You can also choose between ordinary and priority (expedited) processing.
How long does it take to get a patent in India?
The filing process takes 10-12 days. However, the complete patent grant process takes 12-36 months depending on the examination timeline. The patent application is published after 18 months from filing (or earlier with expedited publication). Request for examination must be filed within 48 months of the filing date.
How much does patent registration cost in India?
Our patent registration service starts at ₹15,999 which includes prior art search, patent drafting, and filing. Government fees vary based on applicant type — individual applicants pay lower fees than entities. Additional costs may apply for examination responses and expedited processing.
Do DPIIT-registered startups get any patent fee rebate?
Yes, DPIIT-recognised startups enjoy an 80% rebate on patent filing fees under the Government of India's Startup India initiative. This significantly reduces the cost of patent protection for eligible startups. We can help you with DPIIT registration as well if needed.
What can be patented in India?
To be patentable, an invention must be novel (new), non-obvious (significant improvement), and useful. Items that cannot be patented include mathematical methods, business methods, computer programs per se, scientific theories, artistic works, traditional knowledge, and inventions contrary to public order or morality.
